Scope and responsibility
GERMANN INC, a California corporation doing business as LIVEWORK (“LIVEWORK,” “we,” or “us”), provides recruiting and talent advisory services from Orange County, California. This policy describes personal information practices relating to livework.inc, our client portal, candidate research and submissions, business relationships, and communications.
When we determine why and how information is used for our own recruiting activities, we act as the responsible business or controller, as applicable. When we handle Client-provided applicant information solely on a client’s instructions, we act as a service provider or processor under the Data Processing Addendum. In that case, the client’s privacy notice governs its practices, and we assist it in responding to requests.
Notice at collection
We collect the categories below for the stated purposes. Each category may be disclosed to contracted service providers supporting those purposes, professional advisers, and recipients required by law. Identifiable candidate information is provided to a particular prospective employer only with the authorization described in the Candidate Terms. Retention criteria appear in the Retention section and apply to each corresponding category.
Identifiers and contact details: name, email, telephone number, business or mailing address, profile links, and account identifiers. We use these to communicate, manage accounts, identify candidates and client contacts, arrange introductions, and maintain service records.
Professional and education information: resumes, employment and education history, skills, certifications, portfolios, availability, compensation expectations, and preferred location or work arrangement. We use these for sourcing, evaluation, matching, presentation, and interview coordination. We do not request salary history.
Recruiting records and inferences: interview and reference notes, client feedback, job-related assessments, skills summaries, and judgments about alignment with a role. We use these to support human recruiting evaluation and search management. Inferences may be incomplete or inaccurate and can be challenged or corrected.
Business and transaction information: company contacts, role specifications, engagement records, invoices, billing correspondence, and placement details. We use these to deliver and administer services, maintain accounting records, and resolve disputes.
Communications: inquiries, messages, attachments, and associated delivery or interaction records, including email-open events where enabled. We use these to respond, coordinate services, and understand delivery and engagement. We do not record or transcribe calls without any notice and consent required by law.
Internet and device activity: IP address, browser and device details, page requests, session information, and authentication or security events. We use these to operate and secure the Site, troubleshoot, and maintain account access.
Sensitive information: account-access credentials and information you voluntarily provide that requires special protection, such as an accommodation request. We use credentials to secure access and accommodation information to facilitate access or meet legal duties. We do not request government identifiers, financial account credentials, medical files, precise geolocation, or biometric identifiers in ordinary candidate submissions. Please do not send unnecessary sensitive information.
We do not sell personal information or share it for cross-context behavioral advertising, and we have not done so in the preceding 12 months. We do not knowingly sell or share information about people under 16. These statements apply to all categories above; candidate-directed recruiting disclosures are made for the authorized opportunity, not for unrestricted distribution.
Sources of information
We obtain information directly from candidates, clients, and other contacts; from professional profiles and other lawful public sources; from referrals and references; from clients’ recruiting records and feedback; and from providers operating our systems. We obtain the permissions required for reference inquiries and do not treat public availability as permission for unrestricted use.
Use and disclosure
We use personal information to deliver the services described above, consider relevant future opportunities, communicate, maintain security, comply with law, and establish or defend legal claims. Where required, we provide additional notice or obtain consent before a materially different use. We do not use recruiting data for unrelated advertising or general-purpose model training.
Prospective employers receive authorized candidate profiles and relevant recruiting information. They handle information under their own notices and legal obligations. Candidate profiles are not public and are not distributed indiscriminately across our client base.
Contracted providers support hosting, storage, authentication, communications, business documents, and authorized document processing. They may access information needed for their functions under appropriate contractual restrictions. We may disclose information to professional advisers and authorities when appropriate or required, and in a proposed or completed business transaction subject to applicable confidentiality and privacy protections.
Technology-assisted recruiting
Software and AI-assisted tools may extract resume fields, organize experience, identify skills, and support matching and search administration. LIVEWORK’s process requires meaningful human review of candidate profiles and recommendations before presentation. We do not make solely automated decisions about whether to present a candidate. We do not infer sensitive traits from a face, voice, or other biometric characteristics for recruiting decisions.
Contact careers@livework.inc to correct a profile or request human consideration of information relevant to a search. If a future use of automated decisionmaking requires a specific notice, access right, opt-out, consent, or alternative process, we will implement the applicable requirements before that use. A client’s independent use of technology is covered by its own disclosures and obligations.
Cookies, tracking, and communications
We use cookies and similar local storage for authentication, security, and basic preferences. Under this policy, we do not deploy third-party advertising cookies or cross-site behavioral advertising. Service providers may receive device and activity information to operate and secure their services for us.
Legacy browser “Do Not Track” signals do not change our essential service processing. Global Privacy Control and other legally recognized opt-out signals are handled as required by applicable law; because we do not sell or share information for cross-context behavioral advertising, no such activity needs to be disabled under our stated practices. Browser controls may restrict cookies, but disabling essential storage can affect sign-in.
You may unsubscribe from marketing emails through the message link or by contacting us. Necessary service, account, and legal notices may continue. A recruiting inquiry does not by itself consent to automated marketing calls or texts; any required authorization is obtained separately.
Retention
We keep information only for as long as reasonably necessary for the disclosed purpose, considering service needs, legal retention duties, security, disputes, and your choices. Stopping active recruiting does not require destruction of records that must be retained by law.
Candidate profiles and recruiting records, including related identifiers, communications, and inferences, are retained for relevant searches and future opportunities while the relationship remains active. We review inactive profiles at least every three years and delete or de-identify records no longer needed, subject to required preservation. Where California employment or referral recordkeeping requirements apply, covered records are preserved for at least four years from creation or the relevant employment action, whichever is later, and longer when a pending matter requires it.
Engagement, placement, billing, and related business-contact records are generally retained for seven years after the relationship or transaction ends, subject to longer legal holds. Technical and session records are kept for the period reasonably needed for authentication, security investigations, troubleshooting, and legal obligations; relevant event records may be preserved with an incident or dispute file. Sensitive information is retained only while needed for access, the specific authorized purpose, or applicable legal duties.
Client-controlled applicant data is retained according to documented instructions and the DPA, subject to legal obligations. Deleted data may remain in restricted backups until the ordinary overwrite cycle completes. Such copies are not used for active recruiting or other new purposes.
Privacy rights and requests
Depending on applicable law and our obligations under it, you may have rights to access or obtain a copy of personal information; learn its categories, sources, purposes, and recipients; correct inaccurate information; request deletion; opt out of sale, sharing, targeted advertising, or certain profiling; and limit specified uses of sensitive information. Those opt-out rights apply where the corresponding processing occurs. We use sensitive information only for permitted service, security, accommodation, and legal purposes and do not use it to infer characteristics about you.
We will not discriminate or retaliate against you for exercising a privacy right. Even when a particular statute does not apply, you may ask us to correct your profile, stop future presentations, or stop recruiting outreach. Some requests cannot be fulfilled in full because of lawful retention requirements or another exception; we will explain the applicable reason.
Email privacy@livework.inc with “Privacy Request” in the subject line, or write to the postal address below. We operate exclusively online and maintain a direct relationship with the people we work with, so email and postal mail are our designated request methods. No account is required to submit a request.
We verify access, correction, and deletion requests using information reasonably matched to our records and may request additional information proportionate to the sensitivity involved. An authorized agent may act for you with valid authority; where permitted, we may ask you to confirm authorization or identity. We do not require identity verification for an opt-out where the law prohibits it.
Where the CCPA applies, we acknowledge access, correction, and deletion requests within 10 business days and ordinarily respond within 45 calendar days. If legally permitted, we may extend that period by another 45 days after giving timely notice and reasons. Other requests, including applicable opt-outs, are handled within their statutory deadlines. Where applicable state law provides an appeal, email privacy@livework.inc with “Privacy Appeal”; we will explain the outcome and any further complaint route within the required period.
For information processed solely for a client, we will direct the request to that client and provide the assistance required by our agreement and law.
Security and processing locations
We maintain administrative, technical, and organizational safeguards appropriate to the information and risk, including access restrictions, confidentiality duties, and measures to protect stored and transmitted data. No system can guarantee absolute security. We respond to incidents and provide legally required notifications.
Our services are operated from the United States. Providers may process information in other locations subject to applicable contracts and legal requirements. Do not assume all information remains in California or the United States unless an executed agreement expressly provides that restriction.
Age restrictions and policy changes
Our services are intended for adults age 18 or older. If we learn that we collected information from someone under 18 through these services, we will remove it from active recruiting and delete it except where preservation is legally required.
We review this policy at least annually and update its effective date when revised. We will give appropriate notice of material changes and obtain consent where legally required. A revision does not authorize retroactive use inconsistent with applicable law.
